A restaurant boss has been banned from working in the food industry after salmon trimmings were found three weeks out of date at a Belper pub.
The discovery was made when environmental health officers checked a dirty kitchen where raw and cooked food were left together, Derby Crown Court has heard.
It was the third time Amber Valley Borough Council staff had raised concerns about the Fishermans Rest pub and restaurant on Broadholme Lane, the court was told.
Former owner Paul Dunne, 63, left the premises in May when legal proceedings began. The pub is now in new hands and have a high hygiene rating issued by the council.
Dunne, of Liverpool, admitted nine breaches of food hygiene rules on March 5. As well as the industry prohibition order, he was ordered to carry out 120 hours unpaid community work.
Recorder Nicholas Syfret QC told him: “It was not a trivial matter. People can be seriously affected by illness arising out of food not being kept or prepared in the proper way. You were given plenty of chances to put matters right.
“You have pleaded guilty to a series of regulatory failures in respect of preparation of food, cleanliness of equipment and cleanliness in general.”
He said Dunne had been visited in December, 2009, and May, 2011 when he had been given “sympathetic but firm guidance” on how to improve standards.
Joseph Willington, prosecuting, said cream was found past its use-by date during the 2009 inspection. There was grease and dirt in the kitchen and Dunne was told the premises were “not satisfactory”.
In 2011, the venue was given a rating of only two out of five under the council’s classification system. Other visits were made when no problems were found.
Alastair Munt, mitigating, said: “He is bankrupt with very little money at all.”
Under the prohibition order, Dunne must take no part in management of a food business. It lasts permanently, although he could apply to a court for it to be lifted.
