AN APPEAL to open a fish and chip shop on Gregory’s Way, in Belper, has been turned down.
Amber Valley Borough Council had turned down the proposed change of use in May. The council ruled that the shop would be close to a residential area, could cause a nuisance and that the potential sale of takeaway food during “unsociable hours” was a concern.
Owner Scott Morgan then appealed to the Government’s Planning Inspectorate and argued that there was already a Chinese takeaway in the area, as well as a Tesco Express store and other shops.
But planning inspector Norma Parish refused Mr Mogan’s appealt. In a report she said: “The principal issues in this case are the likely effect of the proposed development on the living conditions of nearby residents and the visual impact of external ducting on the quality of the environment.”
Residents and police had raised concerns about the possibility of extra traffic and parking, inconvenience and congestion, noise, litter and smells.
