Derbyshire dad ends up in court after he was attacked with metal bar and bicycle

A Derbyshire man was defending himself and his daughter after he was attacked by a man with a metal bar and a bicycle, a court heard.

Simon Duggins, 51, admitted using threatening words and behaviour when he appeared before Chesterfield Magistrates’ Court.

Prosecuting, Michael Little told the court that the incident happened in Lynholmes Road, Matlock, on May 24 last year.

Duggins, of Cardinshaw Road, Matlock, was attacked by the other man who struck him with a metal bar, and when the defendant took it from him he “used his bicycle as a weapon”, Mr Little said.

“The defendant was the victim in this case and was attacked,” he said.

“He shouted threats towards him and his daughter. He was essentially trying to calm the situation down, but he then used a pole to attack the defendant, causing injuries to his head and body.

“The defendant eventually managed to take the pole from him and his attacker then went to kick him and Mr Duggins pulled his shoe off and threw it across the road.

“He was only acting in his own defence and in the defence of his daughter.

“The other man then retrieved his bike and used it as a weapon against the defendant. He admits he went further than necessary in his own defence.”

Mitigating, Serena Simpson said that Duggins had been suffering with mental health issues at the time of the incident.

He was given a conditional discharge and ordered to pay a £20 victim surcharge. Magistrates waved prosecution costs.
