Chesterfield man left in ‘excruciating pain’ after dentist failed to treat decay

A Chesterfield electrician has been awarded £10,000 compensation after his local dentist consistently failed to spot and treat decay that was clearly visible in X-rays.

David Georgeson, a 54-year-old electrician, suffered excruciating pain and discomfort after Dr Ivan Delgado Garrido at Brimington Dental Practice made the error.

The dentist also failed to undertake dental restoration work in a timely fashion that would have stopped the decay from progressing.

As a result, Mr Georgeson has lost a tooth, and will require extensive further treatment in order to correct the problem.

Mr Georgeson visited Dr Delgado Garrido between February 2008 and July 2017.

“Dr Delgado Garrido was my regular dentist,” Mr Georgeson explained. “I just trusted he knew what he was doing. In hindsight I don’t remember him taking many X-rays – if any - or anything like that, but I didn’t think much of this at the time. I thought if he said my teeth were fine, they were.”

Unfortunately for Mr Georgeson things started to go wrong.

“My teeth started to feel sensitive so I went to see Dr Delgado Garrido,” Mr Georgeson said. “But he said he couldn’t see anything wrong. So I just left the practice hoping the pain would subside on its own.”

But Mr Georgeson continued to experience problems with his teeth.

“They were still really sensitive,” Mr Georgeson said. “I knew something wasn’t right, so I went back to see Dr Delgado Garrido. This time, he said one of my fillings needed replacing - I hoped this meant he’d got to the bottom of things and my problem would be resolved.

"However, a couple of months later, one of my teeth broke, and I saw a different dentist.”

It was then that the true extent of Mr Georgeson’s dental problems were revealed.

“It became clear my issues were far from straightforward,” Mr Georgeson said. “I had multiple problems. I was told I had severe decay at the tooth that had fractured.

"As a result, it was too late to save the tooth and it now needed to be extracted. I was really upset as I’d been trying to get Dr Delgado Garrido to do something about it for so long.”

Mr Georgeson contacted the Dental Law Partnership. Analysis of his dental records revealed that Dr Delgado Garrido had consistently failed to spot and treat decay.

The dentist had also failed to restore Mr Georgeson’s tooth in a timely fashion, which would have stopped the decay from progressing. Dr Delgado Garrido also failed to treat decay in another tooth resulting in Mr Georgeson developing and abscess.

This led to the ongoing problems Mr Georgeson experienced. He has lost a tooth and has had to have extensive corrective treatment as a result including, root canal treatment and implant and crown placement.

Mr Georgeson said. “The whole ordeal was horrible, and I’ve had to spend more time in the dentist’s chair and money to get the problems he caused sorted out. It’s unbelievable really.”

The Dental Law Partnership took on Mr Georgeson’s case in 2019. The case was successfully settled in 2020 when the dentist paid £10,000 in an out of court settlement. The dentist did not admit liability.

Dr Delgado Garrido left Brimington Dental Practice in 2017 and it has been under new management since 2018
